You hereby agree to abide by the Terms and Conditions below, any condition and requirement herein or any term mentioned on the Web Site, by entering and using the Web Site and shopping via the web site. PRODUCT AND WEBSITE OUTLOOK
WelderWatch shall not be responsible for errors which may occur while a page is displayed. WelderWatch does not guarantee that the photos contained on the page reflect the real image of the product correctly. The displayed image may differ from the product. The pictures may look different depending on the colour settings of your computer. All pictures should be displayed as images only, but do not guarantee their real image and characteristics.
ORDER CONFIRMATION
Once your order is received, a confirmation e-mail will be sent to your e-mail address. It is important that you provide a correct e-mail address when placing your order. PAYMENT SYSTEMS
You can pay with credit card or debit card. The bank with which WelderWatch will work manages all our banking transactions. WelderWatch does not retain any credit card numbers.
Payment with Credit Card
You can make payment online securely with Visa, AMEX or MasterCard. Your payment is processed by the bank according to secure encrypting and strict banking standards. Your card details are forwarded directly to the bank thus cannot be accessed or read by anyone other than the bank. No extra charge will incur for card payments. When you pay with credit/debit card, the Terms shall apply as soon as the card transactions are confirmed. If no payment is made after your order is placed, WelderWatch may cancel your order automatically.
Promotion Codes
Promotion codes should only be entered during payment. Once you have purchased, it will not be possible to add any promotion code.
PRICE POLICY AND TAXES
All prices given on WelderWatch website are inclusive of 18% VAT, as per the applicable legislation in Turkey. If the product is an order to be shipped to an address outside Turkey, then the price will include import taxes which may arise. Besides, the price will be inclusive of shipment fee for all countries to which the product will be shipped, which will be mentioned with a note “Free Shipping” that will be shown on the product. WelderWatch has the right to correct the prices if the price of the products is not correct. If a price is incorrect, WelderWatch shall have the right to cancel the purchase and refund the amount paid and it may perform such transaction any time.
DISTRIBUTION
No responsibility shall be assumed if the customer has provided an incorrect address. Delivery times are approximate, which is not guaranteed by WelderWatch. The customer is obliged to notify WelderWatch of any delayed delivery, if the product is not delivered within 14 days following the shipment date. Return procedure will start upon notice. WelderWatch shall not assume any responsibility if a customer requesting a return procedure sends the product by courier without receiving the confirmation mail before WelderWatch informs the customer of return confirmation, after the customer has notified WelderWatch of his/her claim and necessary investigations are made.
RETURN PROCEDURE
In case of defective product delivery, the customer should inform WelderWatch via e-mail within 14 days following the delivery and wait until he/she is notified by WelderWatch and send the product by courier when a product return confirmation is sent. If WelderWatch ships a defective product, return shipping fee shall be paid by the company. The product can be returned or replaced, as per the return procedure.
RIGHT OF WITHDRAWAL
The BUYER shall have the right to withdraw within 30 (thirty) days following the delivery of the product(s) of the agreement to him/her or the person/organisation at the address it has assigned, without being obliged to give any reason, on the condition that the product is defective. Shipping fees shall be paid by the buyer if the right of withdrawal is exercised.
GUARANTEE
Guarantee period is 2 (two) years from the purchase date. This guarantee covers the production defects on the watch (movement, case, crystal) and free battery replacement. The issues other than those mentioned above, misuse and the issues mentioned below are not covered by the guarantee.
- Faults and damages (impacts, dents, fracture, broken crystal, etc.) caused by incorrect use and negligence
- Fault or damage caused by unauthorised repair or modification
- Fault or damage caused by fire or water or by natural disaster such as earthquake
- Aesthetical changes due to normal wear and tear (minor scratches, discolouring on the case and / or crystal, peeling on the wrist strap
If originals are not available, the box, hand, crystal, diving watch band can be changed with replacements.
This guarantee warrants that the watch can be replaced free of charge within the time frame and in accordance with the terms and conditions herein and any legal right of the Customer will not be restricted.
INTELLECTUAL PROPERTY RIGHTS
Trademarks, copyrights, intellectual rights and all other priority rights (including but not limited to software, sound, image, text and photos) of the materials published in the content of or at the website belong to WelderWatch companies, subsidiaries thereof or licensors. Any right that is not explicitly mentioned in the content is reserved. The site or its content cannot be used by any means (including whole or partial duplication or storage of such content, including the use for other purposes, distribution without any limitation, reproduction, modification, exhibition and transmission), except for personal or non-commercial use, without the approval of WelderWatch.
User Content: WelderWatch web site may include some contents produced by the user, such as social media applications. WelderWatch does not claim ownership of such content (picture, photo and video, etc.) and assume any legal responsibility. FRAUD TRANSACTIONS
In case a fraud transaction is discovered by WelderWatch or its partner with which it cooperates for fraud transactions; such fraud is forwarded to the relevant units, in which case WelderWatch reserves the right to cancel the purchase transaction.
COMPLETION OF PURCHASE AND TRANSFER OF PROPERTY
The ownership of the property shall entirely belong to WelderWatch until the payment for product is processed. Once your order is received, a confirmation e-mail will be sent to your e-mail address. (WelderWatch), requests your personal details (ID, contact details, credit information, payment information, gender, occupation, education, marital status, etc.) from you via our service channels, verbally or in writing or in electronically (internet/mobile, etc.), save them in paper medium as a reference for the transactions, makes out necessary records and documents, maintains and processes such data, in order to fulfil the conditions of the agreements entered into with our customers and yet offer our customers more quality services and in accordance with our legal liabilities, pursuant to the Law on Protection of the Consumer No. 6502, Regulations for Distance Contracts, other applicable Legislative provisions under Consumer Legislation, Turkish Commercial Code No. 6102, Turkish Criminal Law No. 5237, Law on Protection of Personal Data No. 6698 (“/LPPD/KVKK”) and all other legislation provisions.
Your personal information and data requested can be saved, maintained, updated, disclosed and transmitted by SAAT VE SAAT SAN. VE TİC. A.Ş., as Data Supervisor, in accordance with LPPD and with the procedures and principles specified in other Laws, as specified below, as mentioned in LPPD and processed according to the methods given in LPPD.
Such personal data and information of yours will be processed and maintained for legal retention period or for as long as required by the purpose of processing, by taking all necessary data safety measures, provided that they are not used for the purposes other than the specified purposes and outside the scope; based on your explicit consent or in cases specified in LPPD art. 5/f.2, particularly in the legal legislation that we are subject to, so that you can use the products or services of our company.

LTD. ŞTİ.) or any public or private institutions or organisations authorised to request such data as required by a legal obligation and with other persons, agents, suppliers, retailers, authorised dealers, etc. that we work under an agreement and with our business partners regardless of their capacities, by taking all necessary data safety measures, only based on explicit consent of our customer or in cases specified in LPPD art. 5/f.2, particularly in the legal legislation that we are subject to, with a view to offer our customers different products and services and improve the service quality.
Your personal information will be maintained confidentially in the joint database that belongs to SaatveSaat company groups mentioned above and not shared with third persons for commercial purposes, in accordance with the provisions of art. 12 of LPPD No. 6698. Our company undertakes to take any technical and administrative measures and exercise due diligence to maintain the proper safety level, in an attempt to prevent the illegal processing of personal data for the safety of the data system in which your personal date is stored, prevent illegal access to the personal data and maintain the personal data. In the event that personal data is damaged or seized by third parties as a result of the attacks to the website or the system although our company takes necessary data safety measures, our company will immediately inform you and Personal Data Protection Commission of such event.
Below are given the rights you have as regards your Personal Data, as of 07.10.2016 which is the effective date of this article, as per the article no. 11 of LPPD:
You are entitle to apply to our company and request following information about you;
a) inquire whether any personal data is processed,
b) request information, if personal data is processed,
c) ask why personal data is processed and whether such data is used for the intended use,:
d) get to know about the third persons to which personal data is transmitted, inside and outside Turkey,
e) request to correct any personal data which is processed incompletely or incorrectly,
f) request to delete or remove any personal data, pursuant to terms specified in the article no. 7,
g) request any transaction performed as per the clauses (d) and (e) is delivered to third persons to whom the personal data is transmitted,

Your personal data which is processed for the purposes mentioned above and in accordance with the provisions of LPPD and other laws shall be deleted, removed or anonymised by our company, ex officio or upon the request of the related person if the reasons of data processing is no longer available. These terms of use shall be subject to and construed by Turkish Law, regardless of the principles of enforcement of laws. You hereby agree that Turkish Court shall exclusively be the competent authority in case of any claims or legal disputes about or arising from these terms of use or the Website and in any legal proceeding filed or initiated by WelderWatch.
